- The lawsuit against Coca-Cola, Procter & Gamble, Late July Snacks, Gerber, L’Oreal, Tom’s of Maine, Clorox, and Materne, filed by Last Beach Clean Up, exposed how many of the Terracycle programs, are limited to a certain number of returns. Meaning, if a consumer were to return a product from a participating program, it may not be possible because that program has already reached capacity.
- The Last Beach Clean Up group claimed that since consumers were not aware of these limits, they were misled to believe products were more sustainable than they really are.
- If the Terracycle program already reached capacity consumers were asked to purchase a 'Zero Waste Box' to return the products at a cost of $42 to more than $100.
- For many consumers who were not willing to pay this price, they were faced with trying to recycle the products or throwing them out.
